In 2003, the case of Lanier v. Wal-Mart Stores, Inc. changed the state standard for the outcomes of slip and fall injury cases.

 

As ruled by the court in the 2003 case:

 

A foreign substance on the floor of a retail business that causes a customer to slip, fall, and become injured classifies the state of the store as unsafe condition. In this case it can be assumed that the owner of the store or premises is not ensuring that the location is safe; in other words, this is viewed as negligence on the owner(defendant)’s behalf.

 

In the case of Lanier c. Wal-Mart Stores, Inc., Ms. Lanier slipped and fell as a result of a spill of shampoo/conditioner in the grocery section of the store. At first, liability was denied by Wal-Mart, but the Supreme Court noted that due to fact that customers are encouraged to pick up items as they travel through the store, there is a risk of spills throughout the building.
