We are happy to help service clients that have fallen victim to a slip and fall injury in the state of Kentucky.

The most common places that slip and fall injuries occur is in retail stores such as Kroger, K-Mart, Walmart, Home Depot, or Lowes. This informative page is to cover information regarding slip and fall accidents that occur inside of a retail location.

In 2003, the case of Lanier v. Wal-Mart Stores, Inc. changed the state standard for the outcomes of slip and fall injury cases.

As ruled by the court in the 2003 case:

A foreign substance on the floor of a retail business that causes a customer to slip, fall, and become injured classifies the state of the store as unsafe condition. In this case it can be assumed that the owner of the store or premises is not ensuring that the location is safe; in other words, this is viewed as negligence on the owner(defendant)’s behalf.

In the case of Lanier c. Wal-Mart Stores, Inc., Ms. Lanier slipped and fell as a result of a spill of shampoo/conditioner in the grocery section of the store. At first, liability was denied by Wal-Mart, but the Supreme Court noted that due to fact that customers are encouraged to pick up items as they travel through the store, there is a risk of spills throughout the building.

If you have slipped and fallen inside of a store and wish to seek financial compensation for your injuries, you must have physical proof that there was an existing spill on the floor that caused you to fall.

The store must then defend themselves by proving that no store employee was responsible for the spill that caused the accident, and that the spill did not exist on the floor for an extended period of time that would place them guilty of negligence.

The statue of limitations for a slip and fall injury inside of a retail store is one year from the fall. If you have become injured as a result of a spill inside of a store, it is crucial that you immediately contact an attorney to begin building your case and gathering information and proof that the fall was not your fault.
